Facing Drug Charges? Get Treatment and Get Your Case Dismissed.
If you were arrested for drug possession or user-dealer sales charges, California laws like Penal Code 1000 and Penal Code 1001.36 let you get medical treatment and earn a full case dismissal—with no guilty plea and no criminal conviction.

50 Years of Drug Diversion in California
How Drug Cases Created Diversion in California
Diversion programs in California started with drug cases. In 1972, California created its first drug diversion law (Penal Code 1000). The state recognized that locking up people who were struggling with substance abuse did not work. Instead of punishment, the law offered a deal: get medical treatment for your addiction, and the court will give you a second chance.
In the late 1990s, the law was changed into something called “Deferred Entry of Judgment” (DEJ). This created a dangerous trap: people had to plead guilty up front before starting treatment. If someone had a setback or relapsed—which often happens during addiction recovery—the court immediately entered a criminal conviction without a trial. For non-citizens and immigrants, that initial guilty plea could trigger deportation, even if they later finished the program.
In 2018, California fixed this law through Assembly Bill 208 (AB 208). Today, drug diversion is true pretrial diversion. You plead not guilty and keep all your constitutional rights. As long as you have no drug convictions in the past 5 years, you can participate. Having taken a diversion class years ago no longer blocks you. To enter drug diversion (Penal Code 1000), you temporarily pause your right to a speedy trial and a jury trial during the 12-to-18-month program. If you do not finish the program, any future trial is decided by a judge instead of a jury. For almost everyone, this is a trade worth making, but we will review it carefully with you first.
Purpose-Driven Defense
What Pretrial Drug Diversion Does for You
When you enter drug diversion (Penal Code 1000), the court puts your criminal case on hold for 12 to 18 months while you complete a state-certified education or treatment program. You can complete this program in whichever California county you live or work in.
No Guilty Plea Required
You plead not guilty and stay innocent in the eyes of the law. If you hit a bump in the road during treatment, you are not automatically convicted.
Your Arrest Is Erased
Once you finish the program, your case is completely dismissed (Penal Code 1000.4). By law, the arrest is treated as if it never happened on job, housing, and background checks.
Protection Against Stricter Laws
Under Proposition 36 (passed in late 2024), repeat drug possession charges can now become felonies. Getting diversion on your first case stops a small mistake from turning into a major felony later.
Qualification Checklist (Penal Code 1000)
Do You Qualify for Drug Diversion?
Drug diversion (Penal Code 1000) is meant for personal-use drug charges. To qualify, your charge must be on the state’s eligible list, and you must meet four simple conditions.
Personal-Use Drug Offenses
Covers illegal possession of drugs like cocaine or prescription pills (Health & Safety Code 11350), methamphetamine possession (Health & Safety Code 11377), being under the influence of drugs (Health & Safety Code 11550), possessing drug pipes or needles (Health & Safety Code 11364), open cannabis containers in a car (Vehicle Code 23222(b)), growing small amounts of marijuana for personal use (Health & Safety Code 11358), or getting prescription drugs for personal use (Health & Safety Code 11368).
No Drug Convictions in the Last 5 Years
You must not have any convictions for drug offenses (other than simple personal-use charges) within the past five years. Older criminal records from more than five years ago will not disqualify you.
No Violence Involved
The incident must not involve any violence, threats, or physical harm. Drug diversion (Penal Code 1000) is strictly meant for non-violent, personal substance cases.
No Drug Sales & Clean 5-Year Felony Record
Your arrest cannot involve evidence of selling drugs, and you must have no felony convictions of any kind within the last five years.
Statutory Limits: Possession for sale (Health & Safety Code 11351 & 11378) or selling drugs (Health & Safety Code 11352 & 11379) are automatically blocked from standard drug diversion (Penal Code 1000). For non-drug misdemeanor offenses, explore our page on Judicial Misdemeanor Diversion.
The Pernik Law Strategy: Many people arrested for selling drugs are not major dealers—they sell small amounts just to afford their own addiction. While standard drug diversion blocks sales charges, drug sales are NOT excluded from Mental Health Diversion (Penal Code 1001.36). We use this second door to help clients earn complete case dismissals.
Why Getting Diversion Right Now Is Critical
In late 2024, California voters passed Proposition 36, which allows prosecutors to charge repeat drug possession as a felony. Getting drug diversion on an early charge keeps your record clean and stops future cases from escalating into felonies. Additionally, if you are facing drug sales charges, upcoming changes under Assembly Bill 46 (AB 46) make starting clinical treatment early the single most powerful defense strategy.
Our Two-Track Defense Approach
How We Defend Your Case: Clear Paths for Possession & Sales
We don’t just treat your case like paperwork. We look at why the addiction started so we can solve both the criminal charge and the underlying problem.
Simple Drug Possession & Under the Influence
For personal drug use charges, drug diversion (Penal Code 1000) offers a clear way to dismiss your case. Instead of just sending you to a basic class, we connect you with real medical care so you stay clean for good.
Find Root Cause
We work with therapists to identify what drives the addiction—such as trauma, depression, or anxiety.
Custom Treatment
We combine court-required classes with real clinical therapy so you can recover completely.
Select Best Program
If severe trauma is involved, we can use mental health diversion (Penal Code 1001.36) for a deeper care plan.
Dismissal & Sealing
Complete your program and get your charges dismissed (Penal Code 1000.4) and your record cleared.
Drug Sales Charges (Selling to Feed an Addiction)
Many people charged with selling drugs sell only to afford their own habit. While standard drug diversion blocks sales charges, drug sales are NOT blocked under Mental Health Diversion (Penal Code 1001.36) or Military Diversion (Penal Code 1001.80).
Prove Addiction Drive
We show the court that selling was done strictly to pay for personal drug use.
Medical Evaluation
We bring in doctors to diagnose Substance Use Disorder and any underlying mental conditions.
Early Care Start
You enter treatment right away to show the judge you are serious about recovery.
Court Diversion
We file a court motion for mental health diversion (Penal Code 1001.36) to earn a full dismissal.

Real Case Stories: Overcoming Drug Charges
Behind every court file is a real person. Here is how Pernik Law used California diversion laws to solve both the criminal case and the underlying health crisis.
Healing Trauma Underneath Addiction
Adina struggled with severe heroin addiction for ten years. She went through nearly 30 rehab programs that failed because doctors treated the drugs instead of the severe childhood trauma driving her addiction.
Pernik Law arranged private trauma therapy for her while she was in custody. By treating the root cause, she achieved over two years of clean living, became a licensed professional, and received a full case dismissal and record sealing.

Beating Sales Charges Through the “Second Door”
Charged with felony drug possession for sale, our client was blocked from standard drug diversion (Penal Code 1000). Other attorneys advised taking a plea deal that included state prison time.
Pernik Law proved the selling was done strictly to afford a heavy drug addiction rooted in trauma. We requested mental health diversion (Penal Code 1001.36)—securing diversion, keeping our client out of prison, and opening the door to full dismissal.
Result: Prison Avoided & Diversion Granted
Probation Instead of Mandatory State Prison
A client was caught bringing drugs into a state prison facing mandatory prison time with no initial offer for probation from prosecutors.
Pernik Law uncovered severe childhood abuse and manipulation by an incarcerated partner. We enrolled her in early treatment, showed complete life transformation, and persuaded the judge to grant probation instead of prison.
